RESOLUTION R-2006-2

A RESOLUTION AUTHORIZING THE VILLAGE FISCAL OFFICER TO PAY TO THE FEBRUARY WORKERS COMPENSATION PAYMENT OWED FROM THE GENERAL FUND BASED ON THE EMPLOYEES EXPERIENCE CLAIM RATING FROM THE REVOLVING LOAN FUND ACCOUNT AND DECLARING AN EMERGENCY

WHEREAS, the Village of Windham owes the Ohio Bureau of Worker’s Compensation the sum of $14,303.52 for its February, 2006 payment; to be paid from various Village funds and

WHEREAS, though these funds should come from various funds such funds are not appropriated or currently available from the general fund; and

WHEREAS, there are funds available in the Revolving Loan Fund which funds are available to pay this amount providing that this sum shall be reimbursed to the Revolving Loan Fund account from the general operating fund when available; and

WHEREAS, these sums are currently due and need to be paid to avoid further expenses; and

WHEREAS, this matter is an emergency affecting the health, safety and welfare of the residence of the Village of Windham;

NOW THEREFORE, be it resolved by the Council of the Village of Windham, three-fourths or more of its elected members concur that:

Section One: The Village Fiscal Office is hereby authorized to pay the February Workers Compensation payment2 out of the Village’s Revolving Loan Fund account.

Section Two: It is hereby found and determined that all formal actions of this Council concerning and relating to the adoption of this resolution were adopted in an open meeting of this Council, and that all deliberations of this Council, and of any of its committees that resulted in such formal actions, were in meetings open to the public in compliance with all legal requirements of Section 121.22 of the Ohio Revised Code.

Section Three: This Resolution is hereby declared to be an emergency measure necessary to preserve the public health, safety, morals and general welfare of the inhabitants of the Village of Windham, Ohio and this Resolution shall go into full force and effect immediately upon its passage by three-fourths (3/4's) of the members of Council.
